By accessing and using Pantry Cook ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these Terms of Service, please do not use this service. These Terms of Service constitute a legally binding agreement between you and Pantry Cook ("we", "us", "our", or "Company"). When you create an account, check a box, or otherwise access or use the Service, you are agreeing to be bound by these Terms.
2. License to Use
Pantry Cook grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service solely for your personal, non-commercial purposes. This license does not include the right to:
- Modify, copy, or create derivative works based on the Service
- Reverse engineer, decompile, or disassemble the Service
- Rent, lease, lend, sell, redistribute, or sublicense the Service
- Use the Service for any unlawful purpose or in violation of these Terms
- Resell, transfer, assign, or sublicense your rights under these Terms to any third party
- Use the Service to provide services for the benefit of any third party
3. User Accounts
When you create an account with Pantry Cook, you are responsible for:
- Maintaining the confidentiality of your password and account information
- Ensuring that all information you provide is accurate and up-to-date
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to refuse service or terminate accounts at our sole discretion. We may suspend or terminate your account if we suspect any abuse, including fraud, or if you provide false information.
4. Services Offered
Pantry Cook offers both free and premium subscription services:
Free Tier: Limited features with downgraded functionality.
Premium Tier: Includes upgraded experience and features such as unlimited recipe generations, advanced recipe management, premium recipe images, weekly planner and advanced settings and statistics.
Premium subscription terms:
- Subscription Duration: Monthly or Annual billing cycles
- Payment: Charged in advance via the platform's payment system (Apple App Store, Google Play Store)
- Cancellation: Can be done anytime through the platform's app store subscription management
- Refunds: No refunds for partial subscription periods. Refunds must be requested through the app store platform you used to purchase
- Auto-Renewal: Subscriptions auto-renew unless canceled 24 hours before the end of the current billing period
5. User Obligations and Acceptable Use Policy
You represent that:
- You have full legal capacity and authority to agree to and bind yourself to these Terms
- You are 13 years of age or older
- Your use of the Service will not violate or conflict with these Terms, any applicable laws, rules, or regulations
You agree not to use Pantry Cook for any purpose that is unlawful or prohibited by these Terms. Specifically, you agree not to:
- Violate any applicable laws or regulations
- Infringe on any intellectual property rights
- Harass, threaten, defame, or abuse others
- Transmit viruses, malware, or any code of destructive nature
- Attempt to gain unauthorized access to any portion of the Service or its systems
- Violate or attempt to violate any security feature of the Service
- Interfere or attempt to interfere with the proper working of the Service
- Use any robot, spider, crawler, scraper, or other automated means to access the Service
- Bypass any measures we may use to prevent or restrict access to the Service
- Spam, phishing, or engage in any form of social engineering
- Share explicit, offensive, or abusive content
- Engage in any activity that disrupts the normal functioning of the Service
6. Intellectual Property Rights
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Pantry Cook, its licensors, or other providers of such material. You retain full ownership of all data you enter into Pantry Cook (your pantry items, recipes, meal plans, shopping lists, and preferences). You grant Pantry Cook a worldwide, royalty-free, sub-licensable, and transferable license to use, copy, modify, and display any feedback, suggestions, or improvements you provide for the purposes of operating and improving the Service.
7. Payment Terms
You agree to pay all applicable fees for the Services as set forth in the applicable pricing page within the app. All payment obligations are non-cancellable and all amounts paid are non-refundable, except as otherwise required by law or app store policies. Pantry Cook may suspend or terminate your access to the Services if you fail to pay any fees when due. You are also responsible for any applicable taxes, duties, or fees imposed by your jurisdiction.
8. Consequences of Violation
We reserve the right to suspend or terminate your account and access to the Service at any time and for any reason without prior notice. This includes, but is not limited to:
- Violations of this Terms of Service
- Abusive behavior toward other users or our team
- Illegal activities or attempts to exploit the Service
- Any conduct we deem harmful to the Service or other users
Upon termination, any paid features, credits, or subscription time remaining will not be refunded or credited under any circumstances.
9. Modifications to Service
Pantry Cook reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Pantry Cook shall not be liable to you or to any third party for any modification, suspension, or discontinuation of the Service.
10. Third-Party Services
Pantry Cook uses third-party services to provide and improve the Service:
- Google: Used for cloud storage, authentication, analytics, and real-time database services for premium features
These third-party services are subject to their own terms and privacy policies. We are not responsible for any third-party service outages, data handling practices, or violations of their terms by users. Your use of these third-party services is subject to their respective terms and conditions.
11. AI-Generated Recipes
Pantry Cook uses artificial intelligence (AI) to generate recipes based on your available ingredients and preferences.
11.1 Accuracy Limitations
AI-generated recipes may contain errors or inaccuracies in:
- Ingredient quantities and measurements
- Cooking times and temperatures
- Preparation instructions and techniques
- Nutritional information
- Suitability for specific dietary needs or restrictions
The AI may suggest ingredient combinations that are unusual, non-traditional, or not suitable for your culinary preferences or dietary needs. Please use your own judgment and experience when preparing and following any AI-generated recipe. If you are unsure about any recipe, you may report it through the app's feedback feature at the bottom of the recipe cooking screen.
11.2 User Responsibility
You assume all responsibility for reviewing AI-generated recipes before preparation and following them. You should:
- Verify all ingredient quantities and types are appropriate for your cooking style
- Ensure that cooking instructions are clear and safe
- Before following any AI-generated recipe confirm that no ingredients conflict with known allergies or dietary restrictions
- Assess whether the recipe matches your cooking skill level
- Use your personal cooking judgment and experience
- Not attempt recipes if you are not confident in your abilities
11.3 Testing and Adjustment
We strongly recommend:
- Adjusting recipes based on your personal cooking experience
- Testing new recipes with caution the first time
- Making modifications based on your taste preferences and dietary needs
- Consulting other reliable cooking sources if you're unsure about any instructions
- Consulting professional cooking resources or a nutritionist if you have concerns or questions
11.4 Liability for AI-Generated Recipes
Pantry Cook and its creators are not liable for:
- Recipe failures or incorrect results
- Food safety issues resulting from recipe preparation or ingredient use
- Allergic reactions or adverse health effects
- Damage to property or injury to self or others caused by following any AI-generated recipe
- Inaccuracies or omissions in recipe instructions or nutritional information
If anything in a recipe seems incorrect or unsafe, DO NOT follow it. Always use your judgment and common sense when evaluating and following recipes.
12. Data Ownership and Export
You retain full ownership of all data you enter into Pantry Cook, including pantry items, recipes, meal plans, shopping lists, and preferences. You can delete your data at any time through the app settings. Upon account deletion, we will permanently remove your data from our servers within 30 days.
13. Limitation of Liability
To the fullest extent permissible by law, in no event shall Pantry Cook, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of or inability to use the Service, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages.
14. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Pantry Cook makes no warranties, expressed or implied, regarding the Service. We disclaim all implied warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service or servers are free of viruses or other harmful components.
15. Indemnification
You agree to defend, indemnify, and hold harmless Pantry Cook and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any third-party right or any applicable law
- Any claim that your data or content caused damage to a third party
16. Release
You hereby release Pantry Cook from any claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with any dispute you have with any other user of the Service or any third party.
17. Governing Law and Jurisdiction
These Terms of Service and any separate agreements we may enter into to provide the Service are governed by and construed in accordance with the laws of the jurisdiction in which Pantry Cook operates, without regard to conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the courts in that location.
18. Entire Agreement
These Terms of Service constitute the entire agreement between you and Pantry Cook regarding your use of the Service and supersede all prior or contemporaneous proposals, understandings, and agreements, whether written or oral.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remainder of these Terms will remain in full force and effect.
20. Waiver
Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. No single or partial exercise will preclude any other or further exercise of such right or provision.
21. Changes to Terms
We reserve the right to change these Terms of Service at any time. Changes will be effective immediately upon posting to the application or website. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. We will notify you of significant changes through the app or email where possible.
